Terms of use

1. Owner and subject matter

Audit Snapshot Validator (source code, compiled code, check texts, thresholds, weights, report layout, the offline file and documentation, together the "Tool") is a copyrighted work and a computer program protected under the Polish Act of 4 February 1994 on Copyright and Related Rights (art. 74) and international copyright treaties. ITT Tomasz Oniśk (ILMT Consulting), VAT ID PL8241740926, the "Owner", is the sole owner of all economic rights. All rights reserved.

The Tool is proprietary software and is not released under any open-source licence. Making the code available on a website or in an offline file does not transfer or grant any rights beyond those listed below.

2. Scope of the licence

The Owner grants the user a non-exclusive, non-transferable, revocable, royalty-free licence to:

  1. use the Tool on ilmtconsulting.com and a personally issued offline copy solely to analyse Audit Snapshot files from the ILMT environment of the user's own organisation;
  2. keep the generated report and share it within the user's own organisation, with the user's own advisers and with IBM.

3. Restrictions

Without the Owner's prior written consent it is prohibited in particular to:

  1. copy, distribute, publish, rent, lend or otherwise make the Tool or any part of it, including the offline copy, available to third parties;
  2. modify, translate, adapt, decompile, disassemble or otherwise reverse engineer the code or logic of the Tool, except where mandatory law allows it;
  3. create derivative works, including tools that reuse the Tool's checks, thresholds, weights or texts;
  4. remove or alter copyright notices, attribution or licence terms;
  5. use the Tool to provide services to third parties, for example by consultants or resellers, or for any other commercial purpose;
  6. pass on the offline copy, which is issued by name and marked with the recipient and the issue date.

4. Nature of the results and disclaimer of warranty

The Tool is provided free of charge and as is, without warranty of any kind, express or implied, including any warranty of completeness or accuracy of results or fitness for a particular purpose. It is intended solely as a quick, indicative visualisation of the data contained in an Audit Snapshot file. The score and findings do not constitute a licensing opinion, legal advice, a compliance assessment or any assurance as to the outcome of any audit. Thresholds and weights reflect the author's experience, not IBM requirements.

5. Liability

The user uses the Tool at their own risk. To the extent permitted by law, the Owner is not liable for decisions made on the basis of the report or for any damage arising from use of, or inability to use, the Tool, and no claims against the Owner arise from its use. These limitations do not cover liability that cannot be excluded or limited by law.

6. Data

The Audit Snapshot file is processed solely in the user's browser and is not sent to the Owner's servers or anywhere else. The website records only anonymous statistical events, such as the completion of an analysis, without any content from the file. The offline version records nothing at all.

7. IBM

The Tool is not an IBM product and is not affiliated with or endorsed by IBM. IBM, ILMT, License Metric Tool and BigFix are trademarks of their respective owners.

8. Final provisions

Polish law applies. Disputes are settled by the court competent for the Owner's seat, subject to mandatory rules on jurisdiction in consumer matters. Breach of these terms terminates the licence immediately. The Owner may change the terms by publishing a new version on this page; analyses performed earlier are governed by the version in force at the time of the analysis.
